Card payments are processed for JoyBend by our payment providers. PayPal payments are processed by ATP ITALGRUP Limited on behalf of JoyBend. Whichever way you pay, your order, your guarantee and our customer service are provided by JoyBend under these Terms.

These Terms of Service ("Terms") apply to your use of our website and to any purchase you make from us. By using the website or placing an order, you agree to these Terms and to the policies they refer to, including our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use the website.

2. Eligibility

You must be at least 18 years old to place an order. We currently sell and ship to addresses in the United States only.

3. Health and product disclaimer

JoyBend products are comfort, support and wellness products. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition. Information on this website is for general information only and is not medical advice.

Statements about our dietary supplements have not been evaluated by the Food and Drug Administration. Our supplements are not intended to diagnose, treat, cure or prevent any disease.

Talk to your doctor before using our products if you are pregnant or nursing, take any medication (including blood thinners), have a medical condition or implanted device, are recovering from an injury or surgery, or are scheduled for surgery. Always follow the directions and cautions on the product page and packaging. Stop using a product and consult a doctor if you experience discomfort or an adverse reaction.

4. Products, pricing and availability

We try to describe and show our products accurately, but colours, sizes and packaging may vary slightly from the images. Prices are shown in US dollars and may change at any time before you place your order.

Some products may be sold out or available for pre-order. If an item you ordered becomes unavailable, we will let you know and refund you in full for that item.

If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any order placed at that price or with that information, even after it has been confirmed, and refund you in full.

5. Orders and payment

Your order is an offer to buy. We accept it when we send you a confirmation email. We may refuse or cancel an order, or limit quantities, for reasons including suspected fraud, resale, errors or stock problems; if we cancel after you have been charged, we will refund you in full.

You agree to provide accurate, complete billing and shipping information and confirm that you are authorized to use the payment method you provide. All prices are in US dollars. Applicable sales taxes, if any, are calculated and shown at checkout. You are charged when you place your order.

Payment security. Our checkout pages use encrypted HTTPS connections. Card payments are handled by PCI DSS-compliant payment processors, and PayPal payments are handled by PayPal. We never see or store your full card number.

Your statement. Card payments appear on your statement as JOYBEND, and PayPal payments as PAYPAL *JOYBEND. If you don't recognise a charge, please contact us first: we can look up your order and resolve most issues within one business day.

6. Offers after checkout

After you complete an order, we may show you an optional additional offer. You are only charged for it if you actively choose to accept it. The price and terms are shown before you accept, and these Terms, our Refund Policy and our Shipping Policy apply to it.

7. Subscriptions and automatic renewal

Some products may be offered as a subscription. A subscription is always optional, and a one-time purchase option is available. Before you subscribe, we show you the price, how often you will be charged and shipped (for example, every 30 days), and how to cancel.

By choosing a subscription, you authorize us to charge your payment method automatically at the price and frequency shown at the time you subscribed, until you cancel. We will email you a confirmation of your subscription terms. If a subscription renews at intervals of six months or more, or if we ever offer a trial that converts into a paid subscription, we will email you a reminder at least 7 days before you are charged, with a link or instructions to cancel. If the price of your subscription changes, we will notify you before the change takes effect, and you can cancel before you are charged the new price.

How to cancel: you can cancel at any time by emailing help@joybend.com or calling +1 (754) 242-6834, or through your account or subscription management link where available. To avoid being charged for the next shipment, cancel before your next billing date. Cancelling stops future charges; it does not refund orders that have already been billed and shipped, which remain covered by our 90-day money-back guarantee.

8. Shipping, returns and refunds

Shipping is described in our Shipping Policy. Returns and refunds, including our 90-day money-back guarantee, are described in our Refund Policy. Risk of loss passes to you when your order is delivered to the carrier, but we will help with any lost or damaged delivery as described in our Shipping Policy.

9. Promotions and discounts

Discount codes and promotions are subject to the terms shown with them, cannot be combined unless stated, have no cash value and may end at any time. We may cancel orders that use a code in error or in a way that breaks its terms.

10. Your information and communications

We handle your personal information as described in our Privacy Policy. We will send you transactional emails about your orders and subscriptions. We will only send you marketing emails or text messages if you have opted in. You can unsubscribe from marketing emails at any time using the link in the email, and from text messages by replying STOP. Message and data rates may apply.

11. Reviews and content you send us

If you send us reviews, photos, comments or other content, you confirm that it is your own, accurate and lawful, and you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with JoyBend. We may remove content at our discretion. We do not edit reviews to change their meaning.

12. Intellectual property

All content on this website, including text, images, logos, product names and design, belongs to JoyBend or its licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.

13. Third-party links and services

Our website may link to or use third-party websites and services (for example, payment, shipping and email providers). We are not responsible for their content, policies or practices, and your use of them is subject to their own terms.

14. Prohibited uses

You agree not to use the website to break any law; infringe anyone's rights; submit false or misleading information; upload viruses or harmful code; collect other users' data; interfere with the website's security or operation; or place orders for resale without our written consent.

15. Disclaimer of warranties

Except as expressly stated in these Terms and our policies, and to the fullest extent permitted by law, the website and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the website will be uninterrupted or error-free, or that any product will produce a particular result for you. Nothing in these Terms limits any warranty or right that cannot be excluded under applicable law.

16. Limitation of liability

To the fullest extent permitted by law, JoyBend and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the website or our products. Our total liability for any claim relating to a product or order is limited to the amount you paid for that product or order. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

17. Indemnification

You agree to indemnify and hold JoyBend harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the website or our products.

18. Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. If a dispute cannot be resolved informally within 30 days, it will be brought exclusively in the state or federal courts located in Broward County, Florida, and you and we consent to their jurisdiction. Nothing in this section prevents either party from bringing a claim in small claims court where eligible.

19. Changes, termination and general terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date and applies to orders placed after that date. We may suspend or end your access to the website if you break these Terms.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with the policies referred to above, are the entire agreement between you and us about your use of the website and your purchases.
